Until recently, the internal-investigations function of a compliance office was often treated as an afterthought. Whistleblower hotlines and online ethics training shared most of the spotlight. In many companies, significant investigations were farmed out to outside counsel, and the investigation of less-significant cases was not much more than just memorializing what happened for the compliance office’s file.
As more investigations are being handled in-house, a competent investigation staff not only needs to be proficient in investigations techniques, it requires compliance officers to ensure that the investigation process survives the company’s internal political forces.
Mr. Bloch talked about management of the investigative process within the corporate environment. The focus was directed to the management techniques and processes which can help assure that the investigation process survives as an embedded, yet independent, business function.
That said, the best defense is prevention. Dan Karson, of Kroll, discussed the business value that adequate processes and practices can have to the enterprise by avoiding the problem in the first place. Mr. Karson’s presentation included the importance of conducting background checks. Topics covered:
- The mind set of management when it comes to investigations
- Using investigations as business intelligence
- Integrating the process with other key departments and their limitations
- What to do with your findings (reports, bulletins and counseling)
- Proactive marketing (i.e. risk audits)
Takeaways:
- Insights into how business executives may view your functions
- Steps to ensure you learn of incidents when they arise
- Ways to market the value of investigation findings.
