Conflict of interest policies are as important in their own right as codes of conduct. When surveyed in a former ACUA web seminar, approximately 18% of respondents said their campus had not developed a Conflict of Interest Policy.

As proposed legislation is talked about by the Senate Finance Committee in Washington DC, it sounds like conflict of interest policies will be required for all nonprofits, including education, to have in place. The IRS is currently changing all 990 forms to include a box to check to ensure that your campus has a policy. Even if you already have a conflict of interest policy, you will want to listen to make sure that your policy follows the proper form.

Kristine Dunne, Associate, Arent Fox PLLC
Kristine Dunne specializes in litigation and counseling relating to employment, labor and OSHA matters, in addition to providing legal advice to educational institutions. She currently serves on the firm’s Pro Bono Committee. Kristine counsels employers on compliance issues including personnel policies, fair labor standards, and unfair labor practices.

Laure Bachich Ergin, Senior Associate General Counsel, Chief Compliance Officer, Drexel University. 
Laure received both her undergraduate and law degree from Saint Louis University. She specializes in faculty and student affairs, labor and employment relations, non-profit and tax-exemption issues, intellectual property and compliance matters and is responsible for maintaining a confidential "hotline" reporting system and investigating all “hotline” complaints. Ms. Ergin has lectured for Drexel’s School of Education and is a member of the National Association of College and University Attorneys.
